Pomona (Unincorporated Town of Ramapo), NY

This unique application arises from the sale of the Rockland County acute care nursing home and hospital to a private entity. The facility was exempt from Town of Ramapo zoning regulations when it was built. The exemption continues while it is being operated by the County. It becomes subject to those regulations when it is transferred to the private operator/owner.

The Town of Ramapo first agreed that the use was to be considered a legal, prior nonconforming use (“grandfathered”). Thus, the need for a new special permit from the Town Board was avoided. This set the stage for a subdivision that carved out the nursing home/hospital and an adjoining laundry facility. A site plan for the new lot is also required.

Because the new lot line encompasses only the building area, without setbacks or yards, multiple variances are required.
